The Codigo Municipal (Ley N.º 7794) is the law that organizes the operation of municipalities in Costa Rica, including the legal basis of the commercial patent that is described operationally in the record of "Patente comercial - Municipalidad de Desamparados".
Legal basis of the patent: according to Articulo 88 of the Codigo Municipal (in its current numbering, after the renumbering made by Ley N.º 9542 of 2018; in texts prior to that reform the same article appeared as 79), obtaining a municipal license (patent) is a mandatory legal requirement to conduct any lucrative activity within the territory of a canton, through the payment of a tax that is levied for the entire period during which the activity is carried out or the license is held. Every person natural or legal entity that carries out an economic activity for profit is required to process it. It can only be denied (Articulo 90) when the activity is contrary to law, morality or good customs, when the legal or regulatory requirements are not met, or when the physical location is not permitted by law or municipal regulation.
Legal nature of the patent: the municipality delegates to the holder of the patent the authority to conduct and exploit the lucrative activity necessary for the development of the canton. The patent certificate grants rights, but also imposes obligations that must be faithfully fulfilled — non‑compliance can generate sanctions according to the regulations and the current laws.
Common requirement among municipalities: a certification is usually required from the Contaduria (or the municipal tax area) regarding whether the interested person has tax, contractual or other obligations outstanding with that municipality, before processing the patent.
Important note: although the Codigo Municipal is a national law, each municipality issues its own patent regulation with the requirements, fees and specific procedures for its canton (see the directories of municipalities by province). The Codigo Municipal establishes the general legal framework, not the operational details of each procedure.
