Ley de Proteccion al Trabajador - ROP and Fondo de Capitalizacion Laboral (FCL)

The Ley de Proteccion al Trabajador (Law No. 7983, published on February 18, 2000) created the mandatory complementary pension system in Costa Rica. Every salaried worker has, in addition to their pension from the basic CCSS regime (IVM), two additional funds accumulated in their name — these are distinct concepts that are often confused.

ROP (Regimen Obligatorio de Pensiones Complementarias): this is an additional pension savings fund, managed by an Operadora de Pensiones Complementarias (OPC) — each worker can choose their own (BN Vital, Popular Pensiones, BAC, Vida Plena, etc.). It is funded through an employer contribution (paid by the employer, not deducted from the worker's salary). ROP funds normally CANNOT be withdrawn until retirement age — it is meant to supplement the pension, not serve as immediately available savings.

FCL (Fondo de Capitalizacion Laboral): this is a separate labor savings fund, also managed by the OPC, funded by an additional employer contribution (historically around 1.5% of the salary). Unlike the ROP, the FCL CAN be withdrawn when the employment relationship ends, regardless of the reason (resignation, dismissal, end of contract) — it can also be withdrawn without ending the employment relationship if the worker completes 5 continuous years with the same employer.

Key difference to remember: FCL can be cashed out when changing jobs; ROP remains saved until retirement (except for specific exceptions regulated by law by the Superintendencia de Pensiones — SUPEN —, such as specific partial withdrawal projects approved by the Asamblea Legislativa in specific years).

ROP withdrawal options upon retirement: scheduled withdrawals, permanent annuity, or life annuity — the choice depends on the accumulated amount. If the calculated monthly amount is less than 10% of the basic regime pension, the entire capital can be withdrawn in a single lump sum.

Note: the exact percentages of employer contributions to the ROP and FCL have been modified by reforms over the years — confirm the current percentage with the CCSS, your OPC, or an accountant before making any payroll calculations.
